Terms and Conditions

Version of 28 October 2026.

1. Seller

The online shop forged-art.com is run by Mieczysław Nylec, trading as M.B. Mieczysław Nylec, ul. Sandomierska 55, 39-200 Dębica, Poland, VAT ID (NIP) PL8721319799, REGON 180114669 (“we”). Contact: forged.art.studio@gmail.com, phone +48 883 778 779, or the contact form.

2. Definitions

A consumer is a natural person buying for purposes outside their trade, business or profession. A business is anyone buying in connection with their trade, business or profession. A sole trader whose purchase is not of a professional nature for them is treated like a consumer as regards the right of withdrawal and the rules on non-conformity (Polish Consumer Rights Act, art. 38a).

3. Products

Our sculptures are made by hand, so each piece can differ slightly from the photos in shape, color and size; this is a feature of handmade work, not a defect. Most pieces are made to order after you buy them; some are in stock and ready to ship. Dimensions given as “approx.” are approximate. Sculptures are decorative objects, not toys; they may have sharp edges and points and are not intended for children.

4. Order and contract

To order, add products to the cart, enter your details, choose a shipping method and payment method, accept these terms and click the order button, which means an obligation to pay. You will receive an automatic email confirming that we received your order. The contract is concluded when we confirm your order by email. For made-to-order pieces we state the expected lead time, usually 30 to 60 days. Depending on the piece and our workshop schedule it may occasionally be longer; in that case we tell you before we start work. Custom commissions (your own size or design) are agreed individually by email before the contract is concluded.

5. Prices and payment

Prices are shown in US dollars (or converted into the currency you choose in the shop), without VAT. For buyers in Poland and other EU countries we add 23% Polish VAT at checkout, shown as a separate line before you pay. EU businesses that enter a valid VAT number (checked in the EU VIES system) buy without VAT under the reverse charge rules. Orders shipped outside the EU are exports and are VAT-free. Shipping is calculated at checkout from the shipping weight and size of the piece and the destination country; large or custom pieces get an individual shipping quote by email before they ship. Prices do not include import duties, taxes or customs fees charged in the destination country, which the buyer pays. You can pay by bank transfer, PayPal or card through PayPal, or the other methods offered at checkout. For custom commissions we may ask for a deposit (zadatek within the meaning of art. 394 of the Polish Civil Code); this does not limit the statutory rights of consumers. Products remain our property until they are paid in full (art. 589 of the Polish Civil Code).

6. Delivery

We ship worldwide. Standard sizes go by tracked courier; large works may go by sea in wooden crates. The delivery time is the lead time plus the carrier’s transit time; carriers’ delivery times are estimates. The risk of loss or damage passes to a consumer when the consumer or a person named by them receives the goods.

7. Damage in transit

Please check the package when it arrives. If a sculpture is damaged, keep the packaging, take photos and email us, preferably within 7 days, so we can file a claim with the carrier and arrange a repair or replacement. This does not limit your statutory rights.

8. Right of withdrawal (consumers)

A consumer may withdraw from the contract within 14 days without giving any reason. The period starts on the day the consumer, or a person they name other than the carrier, takes possession of the goods; for an order of several items delivered separately, from taking possession of the last item. You can withdraw:

To meet the deadline, it is enough to send your statement before the 14-day period ends. We confirm receipt of your withdrawal on a durable medium (email) without delay. You must send the goods back within 14 days of withdrawing; you pay the direct cost of return. We refund all payments received from you, including the cost of the cheapest standard delivery we offer, within 14 days of receiving your withdrawal, using the same payment method unless you agree otherwise; we may hold the refund until we receive the goods back or proof of sending them, whichever comes first. You are liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning (art. 34(4) of the Polish Consumer Rights Act).

The right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized (art. 38(1)(3) of the Polish Consumer Rights Act), for example a sculpture in a custom size or design agreed with you. A standard sculpture from our catalog that we make after your order can be returned.

9. Complaints and statutory warranty

We are liable to consumers for the conformity of the goods with the contract under the Polish Consumer Rights Act (chapter 5a); for non-conformity that appears within 2 years of delivery you can ask for repair or replacement, and in the cases provided by law for a price reduction or withdrawal from the contract. Send complaints by email or post, describing the problem and adding photos if possible. We reply within 14 days; if we do not reply in that time, the complaint is deemed accepted. For businesses, liability under the statutory warranty (rękojmia) is excluded to the extent permitted by law.

10. Out-of-court dispute resolution

Consumers can use out-of-court complaint and redress procedures, for example the help of a municipal or district consumer ombudsman or the Trade Inspection in Poland, or of the consumer protection bodies in their own country. Information is available at uokik.gov.pl.

11. Personal data

We process personal data as described in our Privacy Policy.

12. Copyright

All photos, texts and sculpture designs on this website are protected by copyright. You may not copy, download for reuse, republish or use them in any other shop, listing, advertisement or social media profile without our prior written permission. Sharing a link to a page of this website is always welcome.

13. Changes and governing law

We may change these terms for important reasons, such as changes in the law; orders placed before a change are governed by the terms in force when they were placed. These terms are governed by Polish law, without limiting the mandatory consumer protection rules of the country where a consumer has their habitual residence.
